Welcome to LeaCall. These Terms of Service ("Terms") govern your access to and use of our AI-powered lead qualification platform, including our website, APIs, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using LeaCall's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree with these Terms, you may not access or use our Services.
2. Description of Services
LeaCall provides an AI-powered platform for:
- Automated outbound calling using AI voice agents
- Lead qualification and scoring
- Smart follow-up scheduling and management
- Call analytics and reporting
- CRM integrations and workflow automation
- Dedicated server hosting for enterprise clients
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice.
3. Account Registration
To use our Services, you must:
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Be at least 18 years of age or the legal age of majority in your jurisdiction
- Use the Services only for lawful business purposes
You are responsible for all activities that occur under your account.
4. Acceptable Use Policy
Important Notice
LeaCall maintains strict content moderation and usage monitoring. All calls made through our platform are subject to review by LeaCall administration. Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.
You agree to use our Services in compliance with all applicable laws and regulations, including but not limited to:
- Telecommunications Regulations: TCPA (Telephone Consumer Protection Act), TSR (Telemarketing Sales Rule), and equivalent regulations in your jurisdiction
- Do-Not-Call Lists: National and state do-not-call registries
- Data Protection Laws: GDPR, CCPA, and other applicable privacy regulations
- Consumer Protection Laws: Truth in advertising and fair business practices
- Industry-Specific Regulations: Financial services, healthcare (HIPAA), and other regulated industries
5. Prohibited Activities
The following activities are strictly prohibited and will result in immediate account termination:
- Fraud & Scams: Any fraudulent, deceptive, or scam-related calling activities
- Harassment: Harassing, threatening, or abusive communications
- Spam: Unsolicited bulk calling without proper consent
- Illegal Activities: Using Services for any unlawful purpose
- Impersonation: Misrepresenting identity or affiliation
- Malware Distribution: Attempting to distribute malicious content
- System Abuse: Attempting to circumvent security measures or abuse our infrastructure
- Discrimination: Discriminatory practices based on race, religion, gender, or other protected characteristics
- Robocall Violations: Prerecorded messages without prior express consent where required
- Caller ID Spoofing: Illegal manipulation of caller identification information
Moderation & Enforcement: LeaCall administration actively monitors platform usage for compliance. We employ automated systems and manual review processes to detect and prevent misuse. Any suspected violation will be investigated, and we reserve the right to:
- Immediately suspend or terminate accounts without prior notice
- Report violations to relevant law enforcement authorities
- Cooperate fully with legal investigations
- Retain evidence of violations for legal proceedings
- Pursue legal remedies for damages caused
6. Your Responsibilities
As a user of LeaCall, you are responsible for:
- Obtaining all necessary consents before initiating calls to any individual
- Maintaining accurate and up-to-date do-not-call lists
- Ensuring call scripts and AI agent configurations comply with applicable laws
- Providing accurate caller identification information
- Training your team on proper platform usage and compliance
- Maintaining records of consent as required by law
- Promptly honoring opt-out requests from call recipients
7. Campaign Approval Process
Mandatory Review Before Activation
All campaigns submitted through LeaCall are subject to review and approval by our administration team before activation. No campaign will go live until explicitly approved by LeaCall administrators.
The campaign approval process works as follows:
- Submission: You submit a new campaign with your call scripts, target audience, and campaign objectives
- Review: LeaCall administrators review the campaign for compliance with our Terms, applicable laws, and ethical standards
- Agent Assignment: Upon approval, an AI agent is linked to your campaign by our team
- Activation: Only after admin approval and agent assignment will your campaign become active
- Rejection: Campaigns that violate our policies will be rejected with explanation. Repeated violations may result in account suspension
This approval process exists to prevent misuse of our platform and ensure all outbound calling activities comply with applicable regulations. LeaCall reserves the right to reject any campaign at our sole discretion.
8. Fees and Payment
- Subscription fees are billed in advance on a monthly or annual basis
- Usage-based charges (call minutes, additional agents) are billed monthly in arrears
- All fees are non-refundable except as expressly stated
- We may change pricing with 30 days' notice
- Failed payments may result in service suspension
- You are responsible for all applicable taxes
9. Intellectual Property
Our IP: LeaCall and its licensors own all rights to the Services, including software, algorithms, AI models, documentation, and branding. You receive a limited, non-exclusive license to use the Services during your subscription.
Your Content: You retain ownership of your data, call scripts, and content uploaded to our platform. You grant us a license to process this content solely to provide the Services.
Feedback: Any suggestions or feedback you provide may be used by LeaCall without obligation to you.
10. Service Level & Availability
We strive to maintain 99.9% uptime for our Services. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be communicated in advance when possible. Enterprise customers may have specific SLA terms in their service agreements.
11. Limitation of Liability & Account Security
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEACALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to LeaCall in the twelve (12) months preceding the claim.
Account Security Disclaimer
While LeaCall implements industry-standard security measures and maintains SOC 2 Type II compliance, you are solely responsible for maintaining the security of your account credentials. LeaCall shall not be held liable for any data breach, unauthorized access, or data loss resulting from:
- Compromise of your account credentials (password, API keys, etc.)
- Unauthorized access gained through your account
- Sharing of account credentials with third parties
- Failure to use available security features such as multi-factor authentication
- Phishing attacks or social engineering targeting your organization
- Malware or security vulnerabilities in your own systems
You agree to immediately notify LeaCall of any suspected unauthorized access to your account. We strongly recommend enabling multi-factor authentication and using strong, unique passwords.
12. Indemnification
You agree to indemnify, defend, and hold harmless LeaCall, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your infringement of third-party rights
- Content of calls made using our platform
13. Termination
By You: You may terminate your account at any time through your account settings or by contacting support.
By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited activities, fail to pay fees, or if required by law.
Effect of Termination: Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days to allow export, after which it will be deleted unless required by law.
14. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the competent courts in Paris, France.
15. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or prominent notice on our platform at least 30 days before taking effect. Continued use of the Services after changes constitutes acceptance.
16. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and LeaCall.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- No Waiver: Failure to enforce any right does not constitute a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign our rights to an affiliate or successor.
